SONG IMAGE is an Australian based company whose mission is to help our customers to create a high-quality photography content. We are committed to providing the best product and service to our customers and this is reflected in our Refund Policy.

Our Refund Policy applies to all purchases made online at www.songimage.com.

Our Refund Policy does not exclude or replace your rights given under the Australian Consumer Law and regulations.

Change of mind

If you have simply changed your mind we do not provide refunds. Special consideration will be given in exceptional circumstances however you must be able to provide satisfactory proof of purchase. Further, the merchandise must be: in saleable condition; unused with all original packaging; returned to us with any gift or bonus received with the merchandise (if applicable); not subject to the exclusions listed below; and the exchange or refund is sought within 3 days of purchase.

SONG IMAGE at its absolute discretion, reserves the right not to offer an exchange or refund for change of mind.

Consumer guarantees

If you believe an item is faulty, you may have rights to a remedy under the Australian Consumer Law. If there is a major failure with an item, you may choose a refund or exchange. If the failure is minor, we will replace the item within a reasonable time. Song Image will require satisfactory proof of purchase before providing a remedy under the Australian Consumer Law.

Return tender

Refunds will be given using your original payment method

Gift or bonus with purchase and bundled items

Where merchandise is purchased with a gift or bonus, the gift or bonus must also be returned (unless otherwise stated). If you are unable to return the gift or bonus, or it is not in saleable condition, the value of any available refund will be reduced by the value of the gift or bonus. In the instance of bundle offers, all items within the bundle must also be returned or the value of the unreturned items will be deducted from any available refund. Where items in the bundle cannot be returned you will only receive a refund on the value of the merchandise as per this policy and at the discretion of Song Image.

Privacy when making a return

Song Image is committed to protecting your privacy. Information collected when returning merchandise will be securely stored for a reasonable period of time. It may be used for fraud protection activities and for the purpose of Song Image research and analysis. It may be disclosed to state and territory departments upon request, as required by law.

Sales

If products are on sale they will not be refunded.

Agreement

SONG IMAGE Pty Ltd and the Client hereby acknowledge that the following Standard Terms and Conditions are incorporated in and make a part of the Agreement between the parties hereto.

Engagement and Services

The Agreement is between SONG IMAGE Pty Ltd and the Client named in the wedding photography and all the other photography categories contract. The Client wishes to engage SONG IMAGE Pty Ltd and SONG IMAGE Pty Ltd accepts the engagement to hereby:

(a) provide the Services to the Client and

(b) produce Digital Photographs

Contract and Payment Arrangements

An electronically signed wedding photography and all the other photography categories contract and 50% of full price non-refundable retainer is required to secure your booking as we are often booked in advance. Final payment is required no later than two weeks prior to the service date.

These Terms and Conditions may be varied at any time, with or without notice to you, at our sole discretion. You accept that these must be read in conjunction with the current Terms and Conditions available at: www.songimage.com on the bottom of the website. Our terms and conditions apply to all previous, current and future clients.

The Client agrees to pay the Fee to Song Image Pty Ltd. All amounts payable under this Agreement are exclusive of GST. All additional costs such as permits to photograph in national parks or on beaches that require permits, if any, are the responsibility of and must be paid for by the Client.

Cancellations

If a cancellation is made within 12 months from the service date, Song Image Pty Ltd reserves the right to charge the Client the full Fee regardless of how much work has been carried out prior to or after the cancellation including all post processing work which would have been carried out should the wedding or whatever have gone ahead.

Force Majeure Clause

Song Image Pty Ltd is not responsible for any failure to perform any obligation under these T&Cs if its performance has become impossible due to any matter beyond the reasonable control of Song Image Pty Ltd which includes (but is not limited to): fire, flood, tempest, earthquake, riot, civil disturbance, natural disasters, national emergencies, pandemic, government interference, theft, crime, strike, lockout, breakdown, war, or the inability of the Song Image Pty Ltd's normal suppliers to supply necessary matter beyond the reasonable control of Song Image Pty Ltd. In such circumstances, Song Image Pty Ltd will be under no obligation to refund the Deposit or Invoice.

Schedules

Song Image Pty Ltd will provide a schedule for the time that the client has booked. The schedule will include all known times for each component of the service session. It is the responsibility of the client to inform Song Image Pty Ltd of any changes or additions made to the schedule no sooner than 7 days prior to the service session. Song Image Pty Ltd is not responsible for any omissions to the schedule that result in us not being able to carry out our duties. Song Image Pty Ltd will not be held responsible for any lack of photographs delivered due to unknown changes or omissions.

Limitations from venues

Please note that Song Image Pty Ltd is governed by the restrictions imposed by churches, venues and conditions of client's health. In some cases, venues and conditions restrict the movement of photographers, the use of flash or in extreme cases prevent the taking of photographs at all. It is the responsibility of the client to inform themselves of these restrictions and inform Song Image Pty Ltd prior to the service date. Song Image Pty Ltd will not be held responsible for any lack of photographs delivered due to these restrictions.

Copyright in the photographs is retained by the client for private, domestic and personal use only. Any sale or commercial use must have written approval by Song Image Pty Ltd. Song Image Pty Ltd asserts all moral rights attached to the Photographs and the Client does NOT have the right to edit, change, add to, take from, alter or otherwise amend the Photographs without the prior written consent of Song Image Pty Ltd except in the case of cropping an image. The client may submit images to their other vendors for social media use only or to “real case” sections of websites, magazines, and blogs, however, a credit to Song Image Pty Ltd as the photographer must be given in the form of either a social media handle or direct website link. Our social media handle is @song.image and our website link is www.songimage.com.au

Image Style & Editing Process

The client acknowledges that they are familiar with our style, and that our work is continually evolving and are of a unique and artistic nature, that the photos taken may be different from those taken in the past and that Song Image Pty Ltd will use their expertise and artistic judgement to create images consistent with their vision of the wedding, which may be different from the clients. Our editing encompasses colour grading of all selected images for the client in Lightroom, however, our prices do not include cropping or advanced editing/retouching such as individual removal of pimples, scars, double chins or distracting elements. Additional editing may be requested and a fee per image will be quoted upon request and must be accepted prior to any work being carried out.

Image use

Song Image Pty Ltd may use the photographs for advertising or otherwise promoting his work. This is optional and the client must inform Song Image Pty Ltd in writing if they do not wish to have their images used in any advertising or promoting.

Image Storage

Song Image Pty Ltd will keep copies of both your finished jpegs for 5 years and your RAW files for two years from the date of your service date. Client should inform Song Image PTY LTD if they do not wish the Company to keep copies in written.

Delivery

All clients will be supplied with high-resolution jpeg files upon final delivery of USBs. At no stage will RAW files be delivered. Online galleries will be uploaded within a week of the service date excluding public holidays. Final delivery of digital retouched photos will be uploaded no later than 6 weeks.

Attendance

In the unlikely event your chosen photographer is unable to complete the coverage due to unforeseen circumstances such as serious injury or death; we will work together to find a professional photographer to cover your day.

Loss or Damage

Song Image Pty Ltd shall carry out this assignment with due and professional diligence. Elements that are beyond our control include interruption of our service due to guest photographers, faulty material, equipment failure or damage or loss of digital files. In the case of digital file loss, Song Image Pty Ltd and the client agree that the liability of Song Image Pty Ltd shall be limited to a full or partial refund of any money paid under this agreement, which shall be in full & final satisfaction of any damage or loss suffered.

Coverage

Every effort will be made to capture as many moments of your day as humanly possible however it is not possible to capture absolutely everything. If you have suggestions or desires for photos to be captured, please be punctual for the service session you have booked. Song Image Pty Ltd is not responsible for any missing member(s) during the multiple people photo session.

Guest Cooperation

The client is responsible for the conduct of their guests. Song Image Pty Ltd will not tolerate verbally or physically abusive behavior. If the client is unable to control the conduct of their guests, resulting in an unacceptable degree of misconduct, or if the conduct of any of their guests damages the equipment of the photographer and the studio, it will result in the early or immediate departure of the photographer and the termination of the service of the studio. The client understands that in such an event, no refunds will be granted. For all the damages and chaos, the studio reserve the rights of compensation.
